Caution

As a result of its investigation of a report, the Inquiries, Complaints and Reports Committee decided to caution Dr. Eduardo Segura as follows: • Dr. Segura should take a conservative approach to dental treatment and inform patients in a detailed and forthright manner about the risks and benefits of all of their potential treatment options. In some cases, including those involving third molar extractions and endodontic treatment, this process should explicitly include the option for a patient to be seen by a specialist. • It is a dentist’s responsibility to ensure that the manner in which treatment is provided preserves the patient’s interests. Dr. Segura should take a conservative approach to treatment, including allowing for sufficient time to perform the treatment carefully to prevent as many complications as possible and allowing for sufficient time to make adequate records reflecting the treatment. • When a complication does occur, Dr. Segura must inform the patient of the fact of the complication, the possible sequelae related to the complication, and the patient’s options going forward. Dr. Segura should always be mindful that the best option for a patient when a complication has occurred may be a referral to a specialist for treatment and/or follow-up care, and this option should be presented to the patient clearly when that is the case.

Caution

As a result of a complaint, the Inquiries, Complaints and Reports Committee decided to caution Dr. Eduardo Segura as follows: • He has again failed to meet the standards of the profession, including failing to recognize the boundaries of his competence and expertise. He must ensure that he implements the lessons learned through the courses and mentorship ordered by the Discipline Committee. He should reflect on the issues in his practice that have fallen below the standard of practice. If similar issues arise in the future, he can expect a harsher penalty. • Before placing an implant immediately after a tooth extraction, he should consider whether it is in the patient’s best interest to allow the socket time to heal and/or perform a bone graft. If he recommends an immediate implant placement, he must document justification for his recommendation in his clinical notes. • As part of the informed consent process for implant treatment, he must provide a thorough discussion of the pros and cons of immediate and delayed implant placement, both in terms of infected and non-infected sites. • It is his responsibility to ensure that he reviews and updates a patient’s medical history. It is important to consult with a patient’s physician and ask if medical conditions are controlled or optimized. However, it is inappropriate to ask a physician to provide clearance for a surgery that they do not provide.
